The implementation of the South African Constitution in 1996 left an indelible mark on every aspect of society. Naturally, it also had an enormous influence on education in South Africa - to the extent that education, promotion of the best interests of the learner, an equitable labour law dispensation for educators, and the democratic participation of parents, educators and learners in the management of schools began to manifest themselves in tangible ways. In order to ensure a protected space for various interested parties, there was a dramatic increase in litigation in education: educators and school management bodies litigating against departments of education and parents taking schools to court. Against this background it is essential that prospective educators be equipped to keep abreast of these developments. Education law has, therefore, become an indispensable part of any education student's undergraduate training. This title enables the education student to move with ease within the framework of education law practice. A protected space for the educator contributes, in turn, to a protected teaching and learning environment. The title aims to enable the education student to understand and analyse the essence of protection in education, apply the relevant provisions in the constitution to educational practice, interpret and apply education law, ensure a fair labour law dispensation and negotiate the rights and responsibilities of learners in his or her interaction with them.
